The Saeima of the Republic of Latvia has approved amendments to the Public Procurement Law in the third and final reading, marking the beginning of the implementation of public procurement reform in Latvia. The aim of the reform is to create a more efficient, transparent, and flexible procurement system while reducing bureaucracy and strengthening fair competition. From the very beginning of the reform process, the Latvian Chamber of Commerce and Industry (LTRK) actively participated in discussions and working group activities to ensure the most favorable possible conditions for entrepreneurs in the new version of the law.
LTRK’s work in advocacy and public communication has resulted in positive outcomes on several important issues:
- In below-threshold procurements, contracting authorities will be required to publish procurement notices before launching procurements (for goods and services from EUR 20,000, and for construction works from EUR 30,000);
- The threshold for construction procurements has been set at EUR 1 million instead of the initially proposed EUR 5 million;
- Competition law violations have been established as a mandatory exclusion criterion;
- Optional exclusion criteria that are intended to be applied must be specified in the procurement regulations;
- A clear procedure has been established for the replacement of suppliers in cases of business transfer.
The reform of the Public Procurement Law will be implemented gradually until 2028.
